Smart Pilates Terms and Conditions & Service Agreement

Welcome to Smart Pilates Inc. studio

Terms and Conditions, including the Waiver of Liability, govern your use of our website and your participation in all in-person and online classes, services, and events.

BY USING OUR WEBSITE, BOOKING A CLASS, OR PARTICIPATING IN ANY SERVICE, YOU ARE AGREEING TO BE BOUND BY ALL THE TERMS OF THIS AGREEMENT. PLEASE READ IT CAREFULLY. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.

  1. User Representations & Website Use
  • Age Requirement: Services are intended for individuals who are at least the age of majority in their jurisdiction of residence. Individuals under this age require a legal guardian to sign this agreement on their behalf.
  • Account Information: You agree that all registration information you submit is true, accurate, current, and complete. You are responsible for all activity under your account and for maintaining the security of your login credentials.
  • Prohibited Activities: You may not use the Services for any illegal or unauthorized purpose, or in a way that infringes upon our intellectual property rights or the rights of others.

2. Assumption of Risk & Liability Waiver

YOU UNDERSTAND THAT PARTICIPATING IN PHYSICAL FITNESS ACTIVITIES POSES INHERENT RISKS, INCLUDING THE RISK OF INJURY OR ILLNESS. BY ENGAGING IN OUR SERVICES, YOU VOLUNTARILY ASSUME AND ACCEPT ALL RISKS.

  • Release of Liability: You irrevocably release and waive any claims you have now or may have hereafter against Smart Pilates Studio, its owners, officers, employees, instructors, and agents, for any physical or mental injury, illness, damage, or loss that may result from your participation in the Services, whether direct or indirect.
  • Health Disclaimer: Instructors are not medical professionals. Information provided, whether verbal or written, is for general educational purposes only and should not be interpreted as medical advice. You must consult a physician before beginning any exercise program.
  • Client Responsibility: You affirm you are in good physical condition and have no medical conditions that would prevent safe participation. You are responsible for informing your instructor of any injuries, medical conditions, or pregnancy before each session.
  • Right of Refusal: We reserve the right to refuse service or participation if we believe it poses a health risk to you or others.

3. Bookings, Payments, and Cancellations

  • Payments & Refunds: Services must be paid for in advance, and all purchases are non-refundable. Prices may change, but purchased packages will be honored.
  • Booking and Cancellation Policy: Bookings are made online. Cancellations require at least 12 hours’ notice; late cancellations or no-shows incur penalties like fees or lost credits.
  • Membership: Monthly memberships automatically renew. Written notice 30 days prior to the billing date is required for cancellation.

4. Studio Rules and Etiquette (For In-Person Services)

  • General Rules: Appropriate fitness attire, including clean grip socks, is required. Punctual arrival is expected, and late entry might be denied. Respect for staff and members is mandatory, with disruptive behavior potentially leading to service termination.
  • Personal Property: The Studio is not liable for lost, stolen, or damaged personal belongings on the premises.

5. Intellectual Property

All content provided on the website and within classes is our intellectual property, protected by copyright. You may not reproduce or distribute our materials without written consent.

6. Media Release

  • By participating, you consent to the use of your image in photos or videos for promotional purposes, unless you revoke this in writing.

7. General Legal Provisions

  • This agreement is governed by the laws of Ontario and Canada. We may amend these terms, and continued use signifies acceptance of any changes.
